Terms and conditions

1. - COMPANY ORGANISING THE CAMPAIGN

La Reserva de Marbella, S. L., registered in Ctra. N340 PK. 215,6 H. Village, 29630 Benalmadena (Malaga, Spain) and tax code B29008950 has created a promotional Campaign consisting of an Internet raffle of a two (2) nights stay at any of our hotels, for two (2) adults and two (2) children, in an all-inclusive board. The stay includes a spa voucher and transport expenses to the hotel for national and international guests. This campaign is exclusive for EU residents of legal age, according to the participation requirements.

2. -CAMPAIGN START AND END DATES

The Campaign shall start on 4 May 2018 and shall end on 31 May 2018.

3.- PARTICIPATION REQUIREMENTS AND CAMPAIGN DEVELOPMENT

The participation requirements are as follows:

• Any EU residents over 18 shall be allowed to enter the Campaign.
• Any personal data included in the form to participate in the raffle shall be truthful.
• Participants are allowed to register only once to this Campaign.

The Campaign requires clients to complete a form with their data to enter the raffle.

4.- CAMPAIGN REQUIREMENTS AND PRIZES

A winner and a replacement shall be chosen at random, at the internal jury’s discretion, on 31 May 2018.

The winner shall be awarded the following prize: A stay of two (2) nights at any of our hotels, for two (2) adults and up to two (2) children, on an all-inclusive board, including a spa voucher and transport expenses to the hotel.

5.- DISQUALIFICATION AND PENALTIES

If any of the participants should not meet the requirements set in these Terms and Conditions, or the data provided to enter the Campaign were not valid, the participation shall be voided, and the participants shall be excluded from the Campaign, losing any rights regarding the prizes awarded under this Campaign.

6.- VALUE AND NATURE OF THE PRIZE

The prize has an estimated value of €1000.00. The prize consists of a stay of two (2) nights at any of our hotels, for two (2) adults and up to two (2) children, on an all-inclusive board, including a spa voucher and transport expenses to the hotel. Under no circumstances the prize shall be exchanged for money. The winner shall receive the prize via email or telephone. These data shall be extracted from the participation form.

La Reserva de Marbella, S. L. shall not be held responsible for any potential loses, damages, theft or any other circumstances attributable to the services that may affect the delivery of the prizes.

7.- PUBLISHING COMMENTS OR OPINIONS

Comments or opinions whose content is deemed inadequate, that are offensive, abusive or discriminatory or that may violate rights of a third person, shall not be allowed. Comments against a person that violate the principles of the right to honour, to personal and family privacy or one’s image shall not be allowed either. We shall not be held responsible for any damages due to the comments made by Campaign participants and that may, at any moment, damage other participants’ sensibilities.

8.- LIABILITY DISCLAIMER

We shall not be held responsible for the following loses, including but not limited to thefts, delays or any other circumstances attributable to a third party that may affect the development of this Campaign. We shall not be held responsible either for the use made by the participant regarding the prize awarded in this Campaign.

We shall not held responsible in cases of force majeure or fortuitous events that may prevent the development of the Campaign or the total or partial use of the prize.

9.- ASSIGNMENT OF IMAGE RIGHTS AND/OR COPYRIGHT OF THE WINNERS AND/OR THE PARTICIPANTS

The raffle winner agrees and authorises the publication of his/her name and the prize awarded,

as well as the dissemination or communication of his/her image receiving or enjoying the prize, on the website by La Reserva de Marbella, S. L., on its social networks, and any other sales, advertising or media support that La Reserva de Marbella S. L. may use to inform and publish the result of such raffle.

10.- PERSONAL DATA PROTECTION

Under Spanish law L34/2002 of Information society services and ecommerce LSSICE, and Spanish law LO15/99 of 13 December, of personal data protection, we inform you that the data you provided in the participation form shall be processed by LA RESERVA DE MARBELLA S.L. (HOLIDAY WORLD) with the purpose of managing your participation in this raffle. These data shall become part of Holiday World’s files to communicate with you and send you information about other services, offers or activities by HOLIDAY WORLD, by any means, including electronic means, that may be interesting to you.

In the event of resulting the winner, your data (name, surname and your picture) shall be posted on LA RESERVA DE MARBELLA S. L. Facebook fan page or on any social network profile of GRUPO HOLIDAY WORLD (you can check the companies list HERE). By entering this raffle, you agree to such publication of your personal data.

If now or in the future, you do not wish to continue receiving information from LA RESERVA DE MARBELLA S. L. or GRUPO HOLIDAY WORLD and PEÑARROYA, you can send an email to ( privacidad@holidayworld.es ) with the subject “baja comunicaciones comerciales” (unsubscribe from sales emails) from the address you want to unsubscribe. You can also do it by phone, calling +34 952579757.

You can exercise your rights to access, modify, cancel or oppose the use of your personal data by sending a letter, together with a valid proof of identity, to the Data Protection Officer (LA RESERVA DE MARBELLA, S. L.) at the following address: Ctra. Nacional 340, Km 215,6 CP 29630, Benalmadena, Malaga, Spain.

Any personal data provided by participants in the Campaign shall be truthful. Any false personal data shall entitle HOLIDAY WORLD to disqualify the winner and prevent him/her from receiving the prize.

HOLIDAY WORLD shall not be held responsible for any potential loses, damages, delays or any other circumstances attributable to any third party that may affect the development of this Campaign.

These terms and conditions are governed by Spanish law and are subject to the Personal Income Tax. For any disputes that need to be solved legally, both parties agree to be governed by the courts in Malaga, with express waiver of any other jurisdiction to which they might have recourse.

11.- MODIFICATIONS

We reserve the right to modify or extend these Terms and Conditions, as long as they do not damage or impair any of the rights of the Campaign participants.

12.- GOVERNING LAW

These Terms and Conditions are governed by Spanish law. The courts in Torremolinos (Malaga, Spain) shall be authorised to solve any claims or disputes regarding the validity, construction or enforcement of these Terms and Conditions.
